1. Agreement to these terms

These Terms of Service (“Terms”) govern your use of active-intelligencellc.com (the “Site”), operated by Active Intelligence, LLC (“Active Intelligence,” “we,” “us” or “our”), Cherryville, NC 28021. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. About the Site

The Site provides general information about our services, including offer management for advertisers, B2B lead generation, AI technology and funnel optimization. Any services we provide are governed by a separate written agreement, which controls if it conflicts with these Terms. Submitting the contact form or emailing us does not create a client relationship.

• Use the Site for any unlawful purpose or in violation of these Terms
• Submit false, misleading or someone else’s information through our forms

We do not guarantee any particular outcome, including traffic, leads, conversions, sales, revenue or return on ad spend. Diagrams, dashboards and examples on the Site are illustrative only and are not real client data or predictions.

TO THE FULLEST EXTENT PERMITTED BY LAW, ACTIVE INTELLIGENCE, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Site after changes are posted means you accept the updated Terms.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Site.
